Terms & Conditions

These terms govern all services provided by Wicked Gardens LTD. Please read them carefully. By engaging our services, you agree to be bound by these terms in their entirety.

Part A — General Terms & Conditions

Applies to all garden design, landscaping and construction services

1. Company Information

These Terms and Conditions govern all services provided by Wicked Gardens LTD, a company registered in England and Wales (Company No. available on request). Registered office: South East London. These terms apply to all garden design, landscaping, construction, maintenance and related services.

By engaging our services, you confirm that you have read, understood and agree to be bound by these Terms and Conditions in their entirety.

2. Quotations & Acceptance

All quotations are valid for 30 days from the date of issue unless otherwise stated in writing. A quotation becomes a binding contract once accepted in writing by the client and a deposit has been received by Wicked Gardens LTD.

Quotations are based on information provided at the time of the site visit. Additional works discovered during the project — including unforeseen groundwork, drainage issues, structural complications or changes to scope — may result in additional charges. These will be discussed and agreed in writing before any additional works proceed.

Wicked Gardens LTD reserves the right to decline any enquiry or project without providing a reason.

3. Deposits & Payment Terms

A deposit of 50% of the total project value is required a minimum of 7 days before the scheduled start date. The remaining balance is due upon completion of the project. Final payment must be made within 3 working days of project completion.

For garden maintenance services, payment is due after each scheduled visit unless a monthly payment arrangement has been agreed in writing.

Late payment: Outstanding balances will incur interest at a rate of 10% per month on the overdue amount, calculated from the due date. Wicked Gardens LTD reserves the right to suspend ongoing work or future bookings until outstanding invoices are settled.

Accepted payment methods: bank transfer (BACS), cheque. We do not accept cash payments above £500.

4. Cancellation & Postponement

If the client cancels a project after work has commenced, a minimum charge of 50% of the total project value applies to cover materials ordered, labour allocated and preparation costs.

Cancellation within 48 hours of the scheduled start date will result in forfeiture of the full deposit, regardless of whether work has commenced.

Wicked Gardens LTD reserves the right to postpone or cancel work due to adverse weather conditions, supply chain delays or unforeseen circumstances. In such cases, the client will be notified as promptly as possible and work will be rescheduled at no additional cost.

5. Workmanship Warranty

Wicked Gardens LTD provides a 12-month workmanship warranty on all installation work from the date of project completion. This warranty covers the quality of installation technique and structural integrity of works carried out by our team.

The warranty does not cover:

  • Plant survival (dependent on aftercare, weather and conditions outside our control)
  • Damage caused by third parties, extreme weather events or acts of God
  • Normal wear and tear on surfaces and materials
  • Issues arising from client modifications to completed work
  • Damage caused by failure to follow aftercare guidance provided at handover

Any snagging issues must be reported in writing within 7 days of project completion for resolution under warranty. Snagging reported after this period may be subject to a call-out charge.

6. Client Responsibilities

The client is responsible for:

  • Providing clear, unobstructed access to the garden and work area before and during the project
  • Ensuring the work area is clear of personal belongings, furniture and obstacles before work commences
  • Informing Wicked Gardens LTD of any underground services (gas, water, electricity, drainage) within the work area
  • Obtaining any necessary planning permissions or consents required for the proposed works
  • Following all aftercare guidance provided at handover, including watering schedules and maintenance requirements
  • Notifying neighbours of any works that may cause disruption, where applicable

Wicked Gardens LTD accepts no liability for damage to underground services where the client has not disclosed their location prior to works commencing.

7. Insurance

Wicked Gardens LTD holds the following insurance cover:

  • Public Liability Insurance: £2,000,000
  • Employer's Liability Insurance: £10,000,000

Insurance certificates are available upon request. The client is responsible for ensuring their own property and contents insurance is adequate for the duration of works.

8. Materials & Suppliers

Unless otherwise agreed in writing, all materials used in projects will be sourced and supplied by Wicked Gardens LTD from our approved supplier network. Material specifications will be agreed prior to ordering. Substitutions may be made where specified materials are unavailable, subject to client approval.

Natural materials (stone, timber, plants) are subject to natural variation in colour, texture and appearance. Such variation does not constitute a defect.

9. Limitation of Liability

Wicked Gardens LTD shall not be liable for any indirect, consequential, special or incidental losses arising from the services provided, including but not limited to loss of enjoyment, loss of use of the property or loss of anticipated savings.

Our total liability to the client in connection with any project shall not exceed the total value of that project as stated in the accepted quotation.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

10. Intellectual Property

All garden designs, drawings, planting plans and concept documents created by Wicked Gardens LTD remain the intellectual property of Wicked Gardens LTD until full payment has been received. Upon receipt of full payment, the client is granted a licence to use the designs for the specific project only.

Wicked Gardens LTD reserves the right to photograph completed projects and use images for portfolio, marketing and promotional purposes, unless the client requests otherwise in writing prior to project completion.

11. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through direct communication in the first instance. If a resolution cannot be reached within 14 days, either party may refer the matter to a mutually agreed mediator before pursuing legal action.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Part B — Contractor Referral & Commission Policy

Transparency disclosure for contractor recommendations and referral fees

1. Overview

Wicked Gardens LTD operates a Contractor Referral & Recommendation Programme through which we recommend trusted specialist subcontractors and trade partners to our clients. This section sets out the terms under which such recommendations are made and the commission arrangements that may apply.

In the interest of full transparency and in compliance with UK consumer protection law, we disclose that Wicked Gardens LTD may receive a referral commission or fee from certain contractors and suppliers when a client engages them following our recommendation.

2. Commission Disclosure

Where Wicked Gardens LTD recommends a specialist contractor (including but not limited to tree surgeons, electricians, carpenters, pavers, drainage specialists or irrigation engineers) and a commission or referral fee is payable to us upon engagement, we will:

  • Disclose the existence of the commission arrangement to the client before the recommendation is made
  • Confirm the commission rate or fee in writing upon request
  • Ensure the commission does not influence the quality of our recommendation — we only recommend contractors who meet our standards
  • Never recommend a contractor solely on the basis of commission potential

3. Commission Rates

Commission rates vary by contractor and service type. Standard referral commissions range from 5% to 15% of the contractor's invoice value, paid directly by the contractor to Wicked Gardens LTD. This commission is not added to the client's invoice — the client pays the contractor's standard rate.

Where a commission arrangement exists, the specific rate applicable to your referral will be disclosed in writing upon request. You are under no obligation to use any recommended contractor.

4. Contractor Vetting Standards

All contractors recommended by Wicked Gardens LTD are assessed against the following minimum standards before inclusion in our approved network:

  • Demonstrated professional experience and relevant qualifications in their trade
  • Valid public liability insurance (minimum £1,000,000)
  • Positive client references or verifiable track record
  • Alignment with Wicked Gardens LTD quality and professionalism standards
  • Compliance with relevant health and safety regulations

While we take reasonable steps to vet recommended contractors, Wicked Gardens LTD does not guarantee the performance of third-party contractors and accepts no liability for works carried out by contractors engaged directly by the client.

5. Signed Contracts Requirement

For any specialist work referred through Wicked Gardens LTD where the value exceeds £500, we strongly recommend that the client enters into a written contract directly with the contractor before works commence. This contract should include:

  • A clear description of the works to be carried out
  • Agreed price and payment schedule
  • Estimated start and completion dates
  • Warranty or guarantee terms
  • Dispute resolution process

Wicked Gardens LTD can provide a standard contractor engagement letter template upon request. Use of this template does not create any contractual relationship between Wicked Gardens LTD and the referred contractor.

6. Client Rights

You have the right to:

  • Decline any recommended contractor without affecting your relationship with Wicked Gardens LTD
  • Request full disclosure of any commission arrangement before engaging a recommended contractor
  • Source your own specialist contractors independently
  • Request that Wicked Gardens LTD coordinate with your chosen contractor

7. Liability Limitation for Referred Contractors

Wicked Gardens LTD acts solely as an introducer when recommending third-party contractors. Any contract for specialist works is entered into directly between the client and the contractor. Wicked Gardens LTD is not a party to that contract and accepts no liability for:

  • The quality, timeliness or outcome of works carried out by referred contractors
  • Any disputes between the client and a referred contractor
  • Financial losses arising from a referred contractor's failure to perform
  • Any personal injury or property damage caused by a referred contractor

Part C — Garden Maintenance Agreement Terms

Specific terms for scheduled maintenance visits and annual agreements

1. Maintenance Agreements

Garden maintenance services are provided by Wicked Gardens LTD on a scheduled visit basis. Annual maintenance agreements are structured over 12 months with a defined schedule of visits and services agreed in writing at the outset.

A pre-contract garden organisation visit is required before any maintenance agreement commences. This visit is charged separately at our standard hourly rate and covers initial clearance, assessment and preparation of the garden to a maintainable standard.

2. Pricing & Rates

Garden maintenance is charged at £40 per hour per gardener (no VAT). The number of gardeners and hours required per visit will be agreed based on the size and condition of the garden.

Rates are reviewed annually. Clients will be given a minimum of 30 days' written notice of any rate change.

3. What Is Included

Standard maintenance visits include the following services as applicable to the season and garden condition:

  • Lawn mowing, edging and surface clearing
  • Hedge trimming and shaping
  • Pruning of shrubs, perennials and climbers
  • Weed control in borders and hard surfaces
  • Deadheading and plant care
  • Seasonal tidy-up and leaf clearance
  • Basic soil improvement and mulching (materials charged separately)

4. What Is Not Included

The following are not included in standard maintenance visits and will be quoted separately:

  • Tree surgery or large tree work (referred to our approved tree surgeon)
  • Irrigation system installation or servicing
  • Hard landscaping repairs or new construction
  • Large-scale redesign or replanting
  • Waste removal beyond standard green waste (charged at cost)
  • Specialist treatments (moss, algae, pest control — quoted separately)

5. Cancellation of Maintenance Visits

Clients must provide a minimum of 48 hours' notice to cancel or reschedule a maintenance visit. Cancellations with less than 48 hours' notice may be charged at 50% of the scheduled visit cost.

Wicked Gardens LTD reserves the right to reschedule visits due to adverse weather conditions. We will notify clients as promptly as possible and reschedule at the earliest available date.

6. Termination of Maintenance Agreement

Either party may terminate a maintenance agreement with 30 days' written notice. Any visits completed prior to termination will be invoiced at the agreed rate. Prepaid amounts for undelivered visits will be refunded on a pro-rata basis.
